Correction CC&R and Bylaws Vote

Dear Homeowners,
 
At our last Board meeting on May 18 we went forward with the counting of ballots to determine if owners are in agreement with the proposed revisions to the CC&Rs and Bylaws. At that meeting it was represented by our Inspector of Elections that both had passed. 
 
Unfortunately, this was an error. Passage of the Bylaws required a 50% yes vote, and these did pass.  However, the CC&Rs required passage of 67% of the owners, or 134 yes votes. We received 133 yes votes, so the vote to approve the revised CC&Rs did NOT pass.
 
We had 10 votes that were disqualified, so could not be counted. Reasons for disqualification were:
 
– Put more than one ballot in an envelope
– Used the wrong ballot
– Didn’t sign the outer envelope
– Didn’t write the Boulders address on the outer envelope
 
In view of this, our CC&Rs remain exactly the same, with no revisions. In order to understand all of our restrictions, you have to refer to the following documents:  Original CC&Rs dated 2001, two amendments from 2003, and annexation documents for phases 15-19. This is a total of 8 documents.
 
We spent a considerable amount of HOA funds to consolidate the CC&Rs from these 8 documents to one, and make them consistent with current law. Since we fell only one vote short, the board members and CC&R committee will determine whether or not to put this to a vote again.
